Know your Constitutional Rights!

The Fourth Amendment guarantees the "right of people to be secure in their persons, houses, papers and effects, against unreasonable searches and seizures . . . ." U.S. Const. amend. IV.A sexual assault by a police officer clearly violates the security interests protected by the Fourth Amendment. Smith v. Ray, 2011 WL 317166, at *7 (4th Cir. 2011); Fontana v. Haskin, 262 F.3d 871, 878-80 (9th Cir. 2001). Thus, an allegation of sexual assault by a law enforcement officer can constitute an unreasonable seizure.

As far as the Fourteenth Amendment, the "liberty" specially protected by the Due Process Clause includes the right to bodily integrity. Washington v. Glucksberg, 521 U.S. 702, 720 (1997); Albright v. Oliver, 510 U.S. 266, 272 (1994)(the protections of substantive due process extend to the right to bodily integrity). It is apparent, from the dissenting opinion of Judge Parker in McClendon v. City of Columbia, 305 F.3d 314, 335 (5th Cir. 2002), that our circuit has recognized for several years the constitutional principle that there is a substantive due process right to be free from state-imposed violations of bodily integrity in cases involving rape and sexual harassment by police officers. Id. at 336. See Jarrell v. Pearl River County Sheriff's Dept., 2009 WL 4928295, at *3 (S.D.Miss. 2009).

In Texas, a conservator is the court-appointed custodian of the property or financial affairs of a person who is under the age of capacity or who has been declared legally incompetent. During a divorce, at least one person needs to be declared a managing conservator.

A managing conservator must be a parent, a competent adult, an authorized agency, or a licensed child-placing agency. This applies to grand parents also.

Many times, circumstances dictate for the court to appoint one of the parents a Sole Managing Conservator. Why? Because it would be in the best interest of the child pursuant Texas Family Code §153.002.

The best interest of the child shall always be the primary consideration of the court in determining the issues of conservatorship and possession of and access to the child.

Casey Anthony has been on trial for 1st Degree Murder in an Orlando Court Room. After a fierce court battle between attorneys, evidence presented, and medical experts, the jury found her Not Guilty. Representing the wrongfully accused

This week, The Baez Law Firm is representing a wrongfully accused client. This is the case of The State of Texas vs. Rene Gonzales. We are doing this because is the right thing to do.

Rene Gonzales has been accused of aggravated sexual assault with a child. The lead attorney in the case is Mr. Baez, a father of four girls. The reason why Mr. Baez took the case is best explained by him. "There are too many innocent people in Bexar County Jail accused of a sexual assault simply because the DA is not doing its job properly."

Rene Gonzales case is not the exception. Mr. Gonzales DNA was not present in the little girl's underwear. There is no physical evidence that the girl was sexually assaulted. The DNA evidence was taken from the crime lab by some one for long periods of time, which in forensic evidence is a no-no. A DNA profile was made to believe was that of Rene Gonzales, when in reality it was not. The chain of custody of the DNA evidence is questionable.

Too many things that do not add up but yet the DA still prosecuting this case. Dr. Salah best explains this phenomena "the DA has garbage in and garbage out," he states when commenting on the job of the crime lab and the whole prosecution of Rene Gonzales.

We are asking our readers to pray for Rene Gonzales that the truth shall set him free. We also pray that Mr. Baez continue to stand for what is right, even if it means to go against the DA's office in Bexar County.

Retaining wall collapses in a San Antonio neighborhood

AP-On Sunday, a retaining wall in the Northwest side neighborhood The Hills of Rivermist split, opening a 30-foot-deep gash in the ground. Homes were in danger of collapsing and more than two dozen families were evacuated. Engineers moved in Tuesday, dumping tons of dirt in the deepening hole, dubbed a "slope failure" by city officials, in an attempt to prevent further dirt slippage. The neighborhood of Rivermist was built by Centex Homes, a subdivision of Pulte Homes.

The city is keeping a close eye on these repairs and they are also expanding their inspections to other retaining walls around the city. A retaining wall was improperly built and perhaps withou city permits. "We see this type of slope failure in many places if the construction is not done properly," said University of Texas at San Antonio's geotechnical engineering professor Dr. Sassad Shafique.

City engineers have agreed with Shafique, so they have started their own inspections of the wall and houses. The outcome should be reported shortly. We will monitor who gets blamed for the incident.

Texas law is quite clear on the issue of child support; however, it has not been changed for a while. As many of our clients notice, it appears that it is beneficial for the custodial parent in relation to child support, this is because child support is statutory.

For example, when a man a woman are together, it should be the responsibility of the husband to provide for the welfare of the family, specially if there are children involved(although that is not the case with many families). Once a divorce occurs, the non-custodial parent should be responsible for the welfare only of the child, not of the ex. That seems to be a logical way to handle child support, but that is not the way that Texas law is written.

In Texas, even after you are divorce from your ex for years, and you now become better financially, you are still required to provide more (although the law says for the children) but we all know that is for the ex. We say this since, the child's needs (during the marriage) are still are the same whether you are a millionaire or a poor person. In other words, the fact that you now have a better job should not mean that you have to pay more for your child since the child's need have not changed.

July 30, 2009 was a happy day for our family. Our new baby girl arrived. And although we have major medical insurance, Humana One denied our maternity coverage, causing us to pay out of pocket.

Being responsible parents, we decided to inform the insurance company that our baby was on the way, four weeks before the baby was born. We asked them if the baby would be covered, and we were told "once the baby is born, the coverage begins," but we had to call them on the day of the delivery, which we did. We did everything Humana One asked of us to do, so we believed our baby was supposed to be covered. The reality is, this is not what happened at all. Humana One denied the baby's coverage for some bogus, illegitimate reasons, and all to save a dollar. They said that "Texas law does not specifically dictate that we cover a baby once the baby is born, so we are not going to cover the baby." Huh?

As a personal injury attorney, I am aware of the techniques used by insurance companies to increase their bottom line; however, this time, Humana One was wrong. There is nothing on our insurance coverage that indicates that "a new born baby is not required to be covered by Texas laws." That is what Humana One is saying now.

Six flags bankruptcy filing

Associated Press- The amusement park company Six Flags is seeking Chapter 11 bankruptcy protection, saying it needs to reorganize and shed $1.8 billion of debt.

Mark Shapiro, the New York-based company's chief executive officer, says the move won't affect the operation of its 20 theme parks in the U.S., Mexico and Canada... including Six Flags Over Georgia.

Six Flags says it actually had a great year in 2008. It saw 25 million visitors and posted record revenues. But executives are trying to lighten a $2.4 billion debt load that they say is unsustainable.

Saturday's bankruptcy filing came after an earlier plan to negotiate an out-of-court deal with creditors failed. According to sources, Six Flags shares have traded below $1 since September. They closed at 26 cents on Friday.

This weekend, we have been contacted by people who have been arrested since the implementation by the District's Attorneys Office of the policy of blood drawing in you refuse to blow. This is a common phenomena, but we believe that Bexar County DA has taking it to the next level.

As Americans, we have been given many constitutional rights, including the right to privacy, and it is our believe that, every time blood is drawn without consent, our constitutional rights are usurped.

On their website, the Bexar County DWI Task Force placed this info "Peace Officers from across Bexar County are trained and ready for the D.A.'s Office to launch 24hrs of blood draws for those who refuse to provide officers with a breath sample."

As we translate it, they are ready to violate our rights but because they will have the back up of the DA's office, its ok. WOW! Although we do not advocate drinking and driving, we are concerned about people's rights. In other words, if a person has not had any alcohol during the day, refuses to blow for whatever reason, that person would be arrested, have a charge pending, spend thousands on attorneys fees for just saying NO to the sometimes unreliable breathalyzer.

We have defended many people in that scenario and have challenged the bogus science that the breathalyzer brings to the DWI arena, and now, we are ready to challenge the unconstitutionality of the DA's practice.

Today, the Fiesta tradition starts for San Antonians. The only difference is that, if you get pulled over for a DWI, and you refuse to give a breath sample, you will automatically go to jail to have your blood drawn by a nurse. WOW!!!

The DA will do it again

Although the legislature will not pass the random sobriety check points, Bexar County District Attorney will most likely have another mandatory breath or blood test. If you refuse to blow, you will be required to give blood.

Our previous blog covered the unconstitutionality of this practice; however, the District's Attorney is finding a way to get around that, or so they think. They issued warrants for blood test and assume that it is constitutional.

As we explained on our earlier blog, this practice is not constitutional, it just has not been challenged in court, therefore the DA continues to do it.

As our country endures the recession, many couples are suffering from the effects of improper financial planning and the inability to cope with stress, which leads to tensions in the marriage and many times divorce. Although our firm provides services for couples that are seeking divorce, we believe that parent have to always look at the impact that their actions would have on their children.

For the most part, the parents that come to us for dissolution of marriage, have almost always forgotten about what their actions would have on the children of the marriage. They focus on the personal problems and not on the family ones. Our society has blinded us to believe that it is best to take care of our own personal needs, rather than our family ones. This is one of the reasons for infidelity in the marriage.

The man does not feel respected by the wife, because she is always nagging, and so he goes into the slippery road that leads to infidelity. Please blow, don’t say "No” or you will be required to give blood

Many people in bexar county and the city of San Antonio have contacted our law firm because they have been unreasonably and against their reasonable expectation of privacy commandeer to submit to blood test by the Police.

The following information was taken from DA Susan Reed's website: "San Antonio, Texas: For New Year’s Eve, District Attorney Susan Reed is cracking down on drunk drivers. “If you are arrested for a DWI and you say no to the blow, then the police will obtain a search warrant to draw your blood. So, when the officer says “Please blow,” don’t say “No” or you will be required to give blood,” is the District Attorney’s warning. The blood sample obtained by these warrants will be tested by the Bexar County Medical Examiner’s Office to provide critical scientific evidence to secure a conviction against the Defendant. During this No Refusal Accepted evening, an Assistant District Attorney will be on duty at the San Antonio Magistrate’s Office and Detention Facility to assist with and review the blood search warrants that will then be presented to a magistrate. A Registered Nurse will also be on duty to draw the blood. The District Attorney’s Office has met with the various local law enforcement agencies that file DWI cases, trained them on the processes, and has secured their enthusiastic cooperation in this important project. This is the second time No Refusal Accepted has been implemented in Bexar County. Last Memorial Day, the District Attorney’s Office, working with the local police departments, the City of San Antonio Magistrate’s Office, and the Bexar County District Clerk’s Office began a trial run of the program. Approximately 77 people were arrested over the weekend and, of those, approximately 40 blood samples were obtained. The average blood alcohol content was a .16, twice the legal limit of .08. The highest blood test was a .35, more than four times the legal limit."

Some of the research conducted indicated that non-consensual extraction of blood implicates Fourth Amendment privacy rights. Skinner v. Railway Labor Executives' Ass'n, 489 U.S. 602, 16 ('89) ('this physical intrusion, penetrating beneath the skin, infringes [a reasonable] expectation of privacy'); Schmerber v. California, 384 U.S. 757, 67 ('66) (compulsory blood test 'plainly involves the broadly conceived reach of a search and seizure under the Fourth Amendment').' '[f]or the Fourth Amendment does not proscribe all searches and seizures, but only those that are unreasonable.' Skinner, 489 U.S. at 619; accord Vernonia School Dist. 47J v. Acton, No. 95-590, 1995 WL 373274, at *3 (June 26,'95) ('the ultimate measure of the constitutionality of a governmental search is `reasonableness''). A search's reasonableness under the Fourth Amendment generally depends on whether the search was made pursuant to a warrant issued upon probable cause. U.S. v. Place, 462 U.S. 696, 701 ('83).

The question now becomes, which one is greater, the privacy rights of the many citizens of bexar county against the capricious attempt to collect non-consensual blood examples vs. police officers already tainted probable cause to obtain the warrant to collect the blood?

We believe that the police went too far on this one, and perhaps we would be challenging any of the convictions given based on this unconstitutional practice to obtain blood.

Lately, people are contacting our law firm with some of the basic questions for a divorce. Here are some of the most common questions.

IS THERE A RESIDENCY REQUIREMENTS AND WHERE DO I FILE?

YES. Either spouse must be a resident for at least six months and resided in the county where the petition is filed for at least 90 days. On the other hand, the divorce petition is filed with the District Court of the county where either party lives.

WHAT ARE THERE LEGAL GROUNDS FOR DIVORCE?

On the petition of either party to a marriage, the court may grant a divorce without regard to fault on the basis of irreconcilable differences. A divorce may also be granted on the following fault basis: (1) Cruelty, (2) Adultery, (3) Conviction of a felony, (4) Abandonment, (5) Confinement in a mental hospital, (6) Living apart without cohabitation for at least 3 years.

DOES TEXAS RECOGNIZE LEGAL SEPARATION?

NO. Texas has no specific provisions for a legal separation, but allows for temporary orders to be filed at the time the divorce is filed. In cases where the parties have filed for a divorce, the spouses may enter into a written agreement concerning the division of the property and the liabilities of the spouses and maintenance of either spouse.

HOW DOES PROPERTY DISTRIBUTION WORK?

Texas is a community property state. In a decree of divorce, the court shall order a division of the estate of the parties in a manner that the court deems just and right, having due regard for the rights of each party and any children of the marriage. Property that would be considered marital property (whether acquired in the state or not) is subject to division. Property that would be considered separate property (whether acquired in the state or not) is not subject to division.

Division of property in Texas

In Texas, the property and debt issues are typically settled between the parties by a signed Marital Settlement Agreement or the property award is actually order and decreed by the District Court within the Decree of Divorce.

The court shall order a division of the following real and personal property, wherever situated, in a manner that the court deems just and right, having due regard for the rights of each party and any children of the marriage:

1) property that was acquired by either spouse while domiciled in another state and that would have been community property if the spouse who acquired the property had been domiciled in this state at the time of the acquisition; or

(2) property that was acquired by either spouse in exchange for real or personal property and that would have been community property if the spouse who acquired the property so exchanged had been domiciled in this state at the time of its acquisition.

Since Texas is a "Community Property" state, all marital property will be divided in a 50-50 fashion according to the court unless agreed to otherwise by the divorcing spouses. Although this means that everything that is considered "up for grabs" in the divorce, and it will be distributed equally to each spouse, obviously this does not entail splitting a car in half so to speak, but rather each spouse will be rewarded with assets of equal value.

In relation to the debt, it can be used as a bargaining tool or it could be equally distributed to each party, regardless of who created the debt. This is a very common dilemma in almost every divorce case.

The family code covers most issues pertainting property of the community estate. Here are some of the most common provisions.

Sec. 3.001. SEPARATE PROPERTY. A spouse's separate property consists of:

(1) the property owned or claimed by the spouse before marriage;

(2) the property acquired by the spouse during marriage by gift, devise, or descent; and

(3) the recovery for personal injuries sustained by the spouse during marriage, except any recovery for loss of earning capacity during marriage.

Sec. 3.002. COMMUNITY PROPERTY. Community property consists of the property, other than separate property, acquired by either spouse during marriage.

Sec. 3.003. PRESUMPTION OF COMMUNITY PROPERTY. (a) Property possessed by either spouse during or on dissolution of marriage is presumed to be community property.

(b) The degree of proof necessary to establish that property is separate property is clear and convincing evidence.

Sec. 3.004. RECORDATION OF SEPARATE PROPERTY. (a) A subscribed and acknowledged schedule of a spouse's separate property may be recorded in the deed records of the county in which the parties, or one of them, reside and in the county or counties in which the real property is located.

(b) A schedule of a spouse's separate real property is not constructive notice to a good faith purchaser for value or a creditor without actual notice unless the instrument is acknowledged and recorded in the deed records of the county in which the real property is located.

Why bankruptcy?

Bankruptcy has been around for over four hundred years. However, what we assume to be bankruptcy, the elimination of debts, is not what bankruptcy started out as or was intended to become.

Bankruptcy has evolved into the complex process that it is now, but still new provisions should protect consumers more. Widespread changes in consumer bankruptcy law took effect on October 17, 2005, with passage of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005.

Originally, in 1938, Congress overhauled the bankruptcy laws and created the Chapter 13 plan. Another major overhaul took place in 1978. One feature of the act was the hope that more people would use the Chapter 13 provisions and repay their creditors over a multi-year period. Congress did consider making Chapter 13 mandatory for all filers but later allowed it to be voluntary. In the end Congress simply weakened Chapter 13 protections and made Chapter 7, total discharge of debts, more attractive.

The latest changes to bankruptcy law may be making it harder for some people to file bankruptcy. And a few filers with higher incomes are no longer allowed to use Chapter 7 bankruptcy, but will instead have to repay at least some of their debt under Chapter 13. All debtors now have to get credit counseling before they can file a bankruptcy case -- and additional counseling on budgeting and debt management before their debts can be wiped out.

How to handle your creditor's calls...

During trying economic times, companies and individuals can often find themselves with more debt than can be comfortably handled. Specially during this recession. Here are some tips on how to handle your creditors.

Don't take it personally. It will help you to remember that a collection call, no matter how unpleasant, is a business transaction. Not an assault on your personal character.

Remember that is a frequent practice for collectors to attempt to intimidate and scare you. Collectors are paid based upon what they collect. Keep all conversations to the point, professional, and focused on the debt; not irrelevant matters.

Federal law prohibits collection calls before 8 a.m. and after 9 p.m. Nevertheless, many hard-hitting collectors would like to catch the debtor late in the day or early in the morning when they may be more susceptible to emotional pressure.

Let the answering machine work for you at those times. But, when you're ready, emotionally detached, and prepared to deal with it, return each and every call, even if it's just to say, "I have nothing today. " Not responding to phone calls will escalate your account through the collection process and the situation will quickly become out of control.

Remember your rights. In 1996, the Fair Debt Collection Practices Act (FDCPA) was enacted. It specifies that debt collectors cannot harass you. Specifically collectors cannot: call your office, call your home before 8 a.m. or after 9 p.m., address you in an abusive manner or call family or friends in an attempt to collect the debt.

According to the dictionary, bankruptcy is a legally declared inability or impairment of ability of an individual or organization to pay its creditors. Originally, bankruptcy was a way to show how bankers, which used benches or "bank" to exchange money, count money or pay bills. The word was combined to indicate that the banker was broken and out of business. Hence, bankruptcy was used to express a broken banker.

There are two ways in which a person may find themselves in bankruptcy. First, creditors may file a bankruptcy petition against a debtor ("involuntary bankruptcy") in an effort to recoup a portion of what they are owed or initiate a restructuring. Second, bankruptcy is initiated by the debtor (a "voluntary bankruptcy" that is filed by the bankrupt individual or organization).

The landscape has changed for those who are considering bankruptcy, even now with this ecomomic crisis that we are facing. In some cases, some filers with higher incomes won't be allowed to use Chapter 7, but will instead have to repay at least some of their debt under Chapter 13.

Now, all debtors will have to get credit counseling before they can file a bankruptcy case -- and additional counseling on budgeting and debt management before their debts can be wiped out. Under the old rules, most filers could choose the type of bankruptcy that seemed best for them -- and most chose Chapter 7 (liquidation) over Chapter 13 (repayment). The new law will prohibit some filers with higher incomes from using Chapter 7.

Under the new rules, the first step in figuring out whether you can file for Chapter 7 is to measure your "current monthly income" against the median income for a household of your size in your state. If your income is less than or equal to the median, you can file for Chapter 7. If it is more than the median, however, you must pass "the means test" -- another requirement of the new law -- in order to file for Chapter 7.

The purpose of the means test is to figure out whether you have enough disposable income, after subtracting certain allowed expenses and required debt payments, to make payments on a Chapter 13 plan. To find out whether you pass the means test, you subtract certain allowed expenses and debt payments from your current monthly income. If the income that's left over after these calculations is below a certain amount, you can file for Chapter 7.

What is an appeal?

An appeal is a way in which the party that looses in the trial has a chance to show whether the court's decision was in error, or some procedure was violated by the court. For the most part, the party appealing is called the appellant, or the petitioner. The other party is the appellee or the respondent. The appeal is instituted with the filing of a notice of appeal.

This filing marks the beginning of the time period within which the appellant must file a brief, a written argument containing that side's view of the facts and the legal arguments upon which they rely in seeking a reversal of the trial court. In Texas, this notice of appeal must be in writing and within 30 days of the verdict. The appellee then has a specified time to file an answering brief.

Many people believe that cases are always appealed. But that is not always the case. Not often does a losing party have an automatic right of appeal. Usually, there must be a legal basis for the appeal—an alleged material error in the trial—not just that the losing party did not like the verdict.

In a civil case, either party may appeal to a higher court. In a criminal case, only the defendant has a right to an appeal. Appeals by the prosecution after a verdict are not normally allowed because of the prohibition in the U. S. Constitution against double jeopardy, or being tried twice for the same crime.

The right of a federal review imposes the check of the federal courts on abuses that may occur in the state courts. Criminal defendants convicted in state courts have a further safeguard. After using all of their rights of appeal on the state level, they may file a writ of habeas corpus in the federal courts in an attempt to show that their federal constitutional rights were violated.

An appeal is not a retrial or a new trial of the case, although in Texas, a motion for a new trial is required to perfect an appeal. The appeals courts do not usually consider new witnesses or new evidence. Appeals in either civil or criminal cases are usually based on arguments that there were errors in the trial’s procedure or errors in the judge's interpretation of the law.

What are your rights when a police officer stops you on the street? Can they stop you to ask questions? When can an officer arrest you?

There are three basic types of interactions between officers and citizens: the encounter, the investigatory detention, and the arrest. An encounter occurs when a police officer approaches a citizen in public and asks questions but has little reason to believe that a crime has occurred.

During an encounter, you do not have to answer the questions nor do you have to identify yourself to the officer. You are free to walk away. If the officer has “reasonable suspicion” of criminal activity, the officer can detain you and investigate. To meet the standard of reasonable suspicion, the officer must be able to articulate facts of criminal activity. Reasonable suspicion is a low burden for a police officer to meet.

During an investigatory detention, an officer can require a citizen to disclose his name and show a form of identification. Furthermore, during an investigatory detention, if the officer believes his safety is at risk, he may briefly pat down the citizen for weapons.

To arrest a citizen, an officer needs probable cause that the citizen has committed or is committing a criminal offense. Probable cause means that given all the circumstances, a crime probably occurred. Probable cause is also a low burden for the officers to meet.

Divorce law in Texas

Before we can talk about divorce, we must first define marriage. What is the legal definition of marriage? Although it appears confusing now, for purpuse of this discussion we will use the traditional definition of marriage. It is the union of one man and one woman in matrimony, or marriage. This concept was acquired from biblical principals and adopted legally in the US, and it meant a contract between a husband and a wife mostly for the benefit of the husband.

This legal definition of marriage continued in the United States until the middle of the nineteenth century, when states enacted married women's property acts. These acts conferred legal status upon wives and permitted them to own and transfer property in their own right, to sue and be sued, and to enter into contracts. A concept never imagined before this time.

Although these acts were significant advances, they dealt only with property a woman inherited. The husband, by placing title in his name, could control most of the assets acquired during marriage, thus forcing the wife to rely on his bounty. Texas follows the common law doctrine of community property which confers title to both parties during the marriage equally.

Divorce law has also changed over time. In colonial America, divorce was extremely rare. This was partly because obtaining a divorce decree required legislative action, a process that was time-consuming and costly. Even with availability, divorce remained a highly conflicted area of law. The Catholic Church labeled divorce a sin, and Protestant denominations saw it as a mark of moral degeneration. The adversarial process presented another roadblock to divorce.

In the nineteenth century, consensual divorce was not known. For a couple to obtain a divorce, one party to the marriage had to prove that the other had committed a wrong of such weight that the marriage must be ended. The need to find fault was a legacy of family law that was not changed until the 1970s. Texas is a no fault divorce state which means that no prove is required of any wrong doing in order to obtain a divorce.
